P/s: Yesterday was the most anticipated episodes (TV3-every Sunday-11am) so far for the Transformer Animated series season 1 cartoon which Megatron has risen from his decapitated head. Megatron was kept in secrecy by Profesor Sundec after being found headless and many of the key invention he has achieved so far were come from studying him at the Sundec's Tower. On this episode, Megatron has summoned Lugnut to get the precious key and managed to get it from Rachet after some vicious fight. Megatron has now been fully recharged by the confiscated All-spark key from Rachet and now he's back to hunt all the Autobots and rules the entire human world....

P/s: WooWW!!! You can seek scholarship from Najib's office!!! That was something quite new to be heard off from Najib's mouth. Since when Najib's office became one of the scholarship management department? How about the JPA jurisdiction on regards to the approval, management, selection etc. for the Malays scholarship schemes? This 'fool' guy must be one of the special candidates to be offered by the Najib's office for the seeking of the scholarship. Weird statement and this is the most blatant lies I've ever heard from Najib....

KUALA LUMPUR: Parti Keadilan Rakyat (PKR) de facto leader Datuk Seri Anwar Ibrahim has filed a suit against his former aide Mohd Saiful Bukhari Azlan for allegedly lodging a false, malicious and libellous police report against him. The suit was filed at the Kuala Lumpur High Court civil registry by Anwar’s lawyers R. Sivarasa, Ranjit Singh and William Leong at about 10.30am on Monday. Saiful had on Saturday lodged a police report alleging that he had been sodomised by Anwar, a former deputy prime minister. Anwar is residing at the Turkish Embassy here, saying that he fears for his life after receiving death threats. - THe STaR ONLiNe

PKR has released four sets of pictures showing the man who made a police report alleging sodomy by Datuk Seri Anwar Ibrahim. The pictures were taken at the office of the Deputy Prime Minister and the accuser was posing with three Cabinet ministers. One of the pictures showed Mohd Saiful Bukhari Azlan, 23, posing with Khairil Anas Yusof, an aide at the Deputy Prime Minister's office.

“I have a picture actually showing the link to the Deputy Prime Minister,” PKR president Datin Seri Dr. Wan Azizah Wan Ismail told a packed press conference after the PKR supreme council meeting. “The young man who lodged the police report (against Anwar) was in the Deputy Prime Minister's office. I think that is explanatory. “Next to the young man is the Deputy Prime Minister's special officer Khairil Anas Yusof,” she said.

Mohd Saiful, a student leader at a local university and Anwar's special assistant during the March general election, made a police report that he was sodomised by Anwar last Thursday. Asked if she was implying that Deputy Prime Minister Datuk Seri Najib Tun Razak was behind the allegation, Dr. Wan Azizah said it was just speculation.

“I mean, the picture is (was taken) at the Deputy Prime Minister's office. That's it,” she said. Asked whether the allegation was another political conspiracy against Anwar, similar to the one in 1998, she said: “Very much so. This is a second conspiracy, a political murder that has been committed against my husband. An attempted murder politically.” On whether the allegation had any relevance to the allegation linking Najib to Mongolian Altantuya Shaariibuu's murder, she said: “You can link it because it's another diversion from the issues we are facing in our country. This is a political diversion.”

Dr. Wan Azizah, however, could not tell when the pictures were taken and did not disclose who forwarded them to her handphone. The other pictures were of Mohd Saiful posing with Agriculture and Agro-based Minister Datuk Seri Mustapa Mohamed, Tourism Minister Datuk Azalina Othman and Domestic Trade and Consumer Affairs Minister Datuk Shahrir Abdul Samad. Asked why Anwar was not present at the press conference, Dr. Wan Azizah said he received a death threat a few weeks ago.

“He is in a safe place to protect him from danger. We have reason to believe that Anwar's safety is at risk. We received death threats. We were given the advice to take care of Anwar's life,” she said. On whether Anwar would lodge a police report on the death threats, she said they would discuss the matter with the lawyers. “We have to protect ourselves at the moment. A lot of Malaysians seek his leadership. Therefore, we have to protect him not only because he is my husband but also because he's the leader of our country,” Wan Azizah said. Terkini!!!!!Presiden Parti Keadilan Rakyat (KeADILan), Datin Seri Dr. Wan Azizah Wan Ismail dalam sidang media sebentar tadi mendedahkan gambar pengadu kes Anwar, Saiful Bukhari Azlan dengan Pegawai Khas kepada Timbalan Perdana Menteri, Khairil Anas Yusof. Gambar itu akhirnya mencetus tanda tanya samada kes dakwaan liwat terbaru membabitkan Anwar itu adalah berpunca dari konspirasi seseorang.

Beliau tidak mendedahkan siapa yang menyerahkan gambar tersebut namun disyaki adanya konspirasi seperti kes pada tahun 1998 membabitkan Anwar. Namun menurut sumber, Saiful adalah Pegawai Khas Anwar yang menjadi sukarelawan ketika pilihan raya umum lalu dan beliau dikatakan bukan ahli KeADILan. Wan Azizah yang mengulas perkembangan terbaru itu menyatakan rasa kecewa dengan dakwaan tersebut yang dikatakan sekali lagi untuk menjatuhkan Anwar.

Malah menurut Timbalan Presiden KeADILan, Dr. Syed Husin Ali, kini konspirasi itu bukan sahaja untuk menjatuhkan Anwar malah mengancam hidup Anwar. Pimpinan KeADILan sepakat mengecam konspirasi terbaru ini yang nyata sekali untuk menjatuhkan Anwar tatkala perkembangan KeADILan semakin hampir memerintah kerajaan, kata Syed Husin. Pimpinan KeADILan sendiri sepakat tidak mempercayai dakwaan Saiful itu malah menyokong penuh kepimpinan Anwar.

Suasana di perkarangan hotel dekat sini semakin bising dengan laungan reformasi dan takbir. Sejak semalam, timbul desas-desus yang menyatakan bahawa Anwar akan ditahan ekoran satu laporan polis yang dibuat terhadapnya semalam. Laporan tersebut dibuat oleh pembantu khas Anwar, Saiful Bukhari Azlan yang mendakwa telah diliwat oleh bekas Timbalan Perdana Menteri tersebut. Sumber KeADILan mengatakan bahawa polis telah menahan pembantu khas Anwar semalam dan memaksanya membuat laporan polis yang dia diliwat oleh Anwar.

Sementara Saiful Bukhari dikatakan sedang memberi keterangan di salah sebuah balai polis di Kuala Lumpur. Anwar bagaimanapun menafikan dakwaan dalam laporan tersebut dan mendakwanya ianya merupakan satu rekaan semata-mata. Sebaliknya, beliau berkata, laporan tersebut diatur oleh pihak-pihak yang berkepentingan untuk 'menyerangnya' sebagai tindak balas terhadap bukti yang diperolehinya, yang membabitkan Ketua Polis Negara, Tan Sri Musa Hassan dan Peguam Negara, Tan Sri Gani Patail berhubung salah laku,termasuk mereka bukti dalam kes-kes terhadapnya pada 1998-1999.

Anwar dijangka membuat laporan polis berhubung bukti-bukti yang diperolehinya itu hari ini. Presiden KeADILan Datin Seri Wan Azizah Wan Ismail mengesahkan perkara itu tetapi tidak diketahui bila dan di mana laporan itu akan dibuat. Dalam kenyataannya pagi tadi, Wan Azizah berkata, Saiful merupakan seorang sukarelawan yang tampil membantu KeADILan, sewaktu pilihan raya umum lalu. Ekoran itu, katanya, mereka tidak membuat sebarang semakan latar belakang pengadu.

Mengenai laporan tersebut, beliau berkata, ia bertujuan untuk mencemarkan masa depan politik Anwar. Menurut Wan Azizah perkara yang sama berlaku sepertimana 10 tahun yang dulu. Anwar, bekas TPM dan Menteri Kewangan, dipecat dari kerajaan pada 1998 kerana didakwa menyalahguna kuasa dan dituduh terbabit dalam perbuatan liwat. Pada 1999, beliau dijatuhkan hukuman penjara enam tahun atas tuduhan salahguna kuasa dan pada tahun 2000, dijatuhkan hukuman sembilan tahun penjara atas tuduhan liwat. Bagaimanapun, pada 2004, Mahkamah Persekutuan telah membatalkan sabitan hukuman liwat dan membebaskan Anwar. TEASER 110: 'CaRTooNKiNi' BY ZuNaR...HeHeHe!!

P/s: What went wrong to our super leaders nowadays? Have they lost their 'miracles touch'? Are they purposely and deliberately looking forward to be a 'scandalous leader' and provocatively creating new generation leaders with some kind of must have high profile cases? (if you don't have any scandalous cases, you won't be able to be a great Malaysia's top leader). Everything went wrong right after the resignation of Dr. Mahathir Mohammad. One-by-one of high profile cases being exposed and interrogated to the public and by the authorities respectively. But none of the cases have a definite ending point or should I say end of the story (someone has to be charged or penalized under legal action). They are blaming each others, exposing conspiracy documents, claiming to have a military intelligence report and etc. Malaysians like us are patiently waiting for the truth to come out. Unfortunately, it's just an imaginary scenes to watch these 'scandalous leaders' to wrap up the backside of their storylines and convince us that they weren't involved in these unscrupulous acts that make us feel discomfort and unsecure of our next generation to come due to their misbehave acts......

ELeGaNCe Is THe NeW NiSSaN-SYLPHY....

Edaran Tan Chong Motor Sdn. Bhd. (ETCM) has launched the all-new Nissan Sylphy (pronounced SIL-fi), a 2.0L mid size sedan today. First launched in Japan, the Sylphy is one of Nissan’s best selling models at over 160,000 units sold in 10 markets worldwide.

P/s: I've some thought about last night news on 'Buletin Utama TV3' which is regarding on the justification of Dato' Seri Nizar Jamaluddin (MB Perak) against the method of his PK's government on making the direct purchasing of the grocery items (rice and sugar) to the hardcore poor Perak's citizens. Actually, it was the best method of doing so. In fact, the method itself could reduce time and money of waiting the open tender to be advertised, managed, sorted, endorsed and implemented. The anger of the certain BN's assemblymen especially Tajol Rosli (Ex-Perak's MB) against the method of PK's distributing goods without using the open tender system were totally can't be accepted despite the facts that these hardcore poor people's are needing the vital substances in urgency and they are the one who have no ability whatsoever to work or to cope with the risen of the fuel prices and other chain reaction items that affected by the soaring.

It was such a humiliated scene to see the BN's assemblymen rose from the chair and commented the Nizar's justification rudely by saying: "Kenape pulak nak beli terus, mereka nie bukannya dikategorikan sebagai mangsa banjir dan bencana alam untuk bagi cepat-cepat bantuan". I'd like to ask the question to Tajol: "How do you find these peoples aren't not supposedly of getting the goods in urgency? Why makes it so difficult of buying these goods to the poorest peoples? You've a lot of options to facilitate the goods. Why does your previous state government can make a direct purchase for the stationary items without undergo rigorous procedures of open tender system? Is it because of the 'mark-up' done by their own cronies that could 'give back' into your personal account?"

I really, really, really feel ashamed with your acts and attitudes towards 'rakyat' feeling. You're not supposed to be our representatives (wakil rakyat). In fact, you've lost the feel of 'rakyat'. Now, you can imagine how on earth they (previous BN's assemblymen) had done it 'sincerely' on distributing, sorting, managing etc. the funds or allocations to helping the poorest peoples in their own represented areas. Moreover, I now already knew why nowadays Malaysian peoples especially the youngsters are rejecting BN because of their arrogant and selfishness against the 'rakyat' will.

'HoW DoeS PM KNoWs THeY're NoT INVoLVeD?': RuLes OF THuMB OF DoLaH: "APe YG SaLaH ADaLaH BeTUL & APe YG BeTuL ADaLaH SaLaH"...

(1) CH Siew: I am very amazed that Pak Lah does not even need to conduct any investigation over the allegation before coming to conclusion that Najib and his wife are not involved in this scandal. He is so quick to know that the allegation is not true and pin point the source of the problem as RPK.

I really admire his ‘improvements’ in handling the matters because it shows the effectiveness of having a parliament of multiple representations. While I applaud the improvements, I can't help but wonder how he did it? Was there any information that he had prior to this RPK revelation? Is he trying to cover up the whole thing? How does he know Najib and Rosmah are not involved? This revelation from a third party as such will cause more harm to Pak Lah than any benefit which I suspect is the reason for such drastic action to cover it up. It seems that his scheme is backfiring on him. The more he denies such allegations, the more it shows that there is something fishy about the whole issue.

(2) Vijay Kumar Murugavell: If it were me, I would make a police report and not use the attorney- general as an errand boy. The next thing I would do is sue for defamation - that would be the reaction of an innocent person wrongfully accused.

More so if the accuser has a gall to risk two years imprisonment for giving a false declaration. Based on his (Najib’s) propensity to deny, lack of visible anger and operating from a distance while the AG and police seemingly do his bidding, I would wager that many do not see his denial as sincere.

In fact he appears cool and calculative - which reminds me of this quote: ‘Denial is a common tactic that substitutes deliberate ignorance for thoughtful planning’. (Charles Tremper)

(3) Ibrahim Musa K: This is a very serious matter. Who is to be believed, Pak Lah the premier or Raja Petra the blogger? Pak Lah categorically asserts that Najib’s wife was not involved in Altantuya’s murder, yet Raja Petra vowed that she was at the scene when the killing took place.

What Pak Lah said could mean that Najib’s wife was not involved in the plot of the murder, but it did not rule out the fact that she was a bystander to the heinous crime (as in Raja Petra’s statutory declaration). This itself would have made her a pivotal witness in court.

Granted whether Raja Petra is trustworthy, the implication of his words would be far and wide if not extraordinary critical to the already chaotic national political scene. It casts an eerie dark shadow that may completely destroy the integrity of the nation’s imminent would-be premier.

(4) Ahmad Kamal: In any case, I think Petra - if he should be detained at all as an accused - should not be detained under any preventive detention law. He should have a very good day in open court as an alleged accused or an important witness. I hope there are enough of us out there to see that justice is done and be seen to be done.

(5) Ko-han Wai: I must say, Raja Petra have some guts signing a statutory declaration (and paying RM4 for the endorsement too..hehehe!!!) on new info in the Altantuya (may she rest in peace) murder case.

Our country needs more people like this. Kudos and salutations to him. However, in this case - again - it is the case of the whistle-blower getting the end of the stick/rod. Insults and threats of jail time are hurled towards Raja Petra.

And still the BN wonders why most of the public voted against them last March. Well, so much for the Whistle-blowers Act proposed by that someone (don't need to say who) in the PM's department. The act will most probably contain a whole lot of nonsensical procedures against the whistle-blower just to keep them away.

Puzzled: "If parties implicated in statutory declaration made by Raja Petra Kamarudin claim that allegations directed at them are garbage and fabricated, then they themselves should sue Raja Petra Kamaruddin for defamation. Timbalan perdana menteri Datuk Seri Najib Razak hari ini menafikan bahawa isterinya Rosmah Mansor terbabit dalam pembunuhan Altantuya Shaariibuu seperti yang didakwa oleh Raja Petra Kamarudin. Najib juga berkata, Rosmah telah dipanggil memberi kenyataan kepada polis ekoran dakwaan terbaru dalam akuan bersumpah penulis sensasi itu. Bercakap kepada pemberita di Parlimen hari ini, Najib berkata akuan Raja Petra itu satu pembohongan semata-mata.

Najib juga menyifatkannya sebagai satu tindakan terdesak untuk mencemarkan imej politik beliau. Sebelum ini, beliau mempengerusikan mesyuarat jawatankuasa kabinet mengenai masalah pendatang tanpa izin di Sabah. Raja Petra, dalam akuan bersumpahnya 18 Jun lalu, mendakwa Rosmah bersama dua lagi berada di tempat kejadian sebelum wanita Mongolia itu diletupkan.

Najib dan isterinya beberapa kali menafikan pembabitan mereka dengan kes ini, yang masih dalam perbicaraan di Mahkamah Tinggi Shah Alam. Pengendali blog Malaysia-Today juga mendakwa perdana menteri menerima maklumat tentang pembabitan tiga individu itu, termasuk Rosmah, dan menyerahkan laporan perisikan kepada menantunya dan juga naib ketua Pemuda Umno, Khairy Jamaluddin. Bagaimanapun, semalam, Datuk Seri Abdullah Ahmad Badawi menafikan ada menerima laporan bertulis daripada perisikan tentera mengenai mereka yang terlibat dalam kes pembunuhan Altantuya.

Abdullah dilaporkan berkata: "Memang saya concern (dengan dakwaan Raja Petra). "Perbuatan Raja Petra itu tidak boleh diterima. Sebab apa yang dia nyatakan itu adalah sesuatu yang tidak betul. "Terutamanya dalam surat itu (akuan berkanun Raja Petra) disebut yang saya dah diberi satu laporan mengenainya dari pihak perisikan tentera. SAPP's Sepanggar MP Datuk Eric Enchin Majimbun is with the party on its plan to pursue a no-confidence motion against the Prime Minister. Denying a news report that he had abandoned the plan, the SAPP deputy president said national newspaper reports quoting him as saying that he never supported SAPP’s no-confidence motion were wrong.

“Our plan for the motion is still on but not necessarily tabled by me. Maybe there will be others who will table it,” he said. Eric also said the SAPP supreme council meeting on Monday had not put any time frame for the no-confidence motion and the party has not decided if he would be the one to table the motion.

On his absence from Parliament, he reiterated the reason given by party president Datuk Yong Teck Lee that it was because of security reasons following intimidation and threats to them and their families by unknown people. Eric and Tawau MP Datuk Dr. Chua Soon Bui, who is also from SAPP, were recalled back to Kota Kinabalu by the party following claims of threats. - The STaR ONLiNe

P/s: WoWWW!!! Awesome new looks of Frenzy. If you look closer, you'll see his head is dramatically different as compared to the previous looks in the Transformers 1. He has some kind of tentacles and I'd probably presume that if Frenzy seems to be appeared in the scene, does it mean that Barricade is still alive after being torn apart by Optimus Prime during the freeway attack? Frenzy is kinda symbiotic thing that needs a host to live as well as to reorganize the attack against Autobots. Same goes to the Scorponok which he is also symbiotically attached to the Blackout. But, I'm not really sure whether Blackout will be coming back or not since Scorponok is still lurking around the Desert area of Qatar and most probably hiding in places despite the facts that he has injured himself quite badly during the counter attack by the USA Military airplane support unit. Anyway, HeHeHe!!!...Looks like Sam is still encountering the same fears as in his first encountered with the Barricade and the dialogues are pretty much the same in the first movie. Only that it happens to be Frenzy himself which somehow is going to get something by intimidating him to get out from the car....HeHeHe!!

Usul kenaikan harga petroleum dan harga barangan yang sepatutnya menjadi medan untuk kepentingan rakyat sebaliknya menjadi usul politik mempertahankan kedudukan Dato' Seri Abdullah Ahmad Badawi sebagai Perdana Menteri. Akhbar, media elektronik dan internet aliran kerajaan melaporkan kedudukan Perdana Menteri belum tergugat hasil daripada keputusan usul tersebut jelas mengambarkan usul itu semata-mata berkepentingan politik bukan kerana rakyat. Usul tersebut dibentangkan secara tiba-tiba oleh kerajaan melalui Menteri Perdagangan Dalam Negeri dan Hal Ehwal Pengguna, Dato' Shahril Abdul Samad, di Dewan Rakyat yang mula bersidang semalam.

Tindakan Perdana Menteri mencadangkan usul tersebut dibentangkan di Dewan Rakyat sebagai langkah menutup malu apabila terdapat anggota ahli Parlimen Barisan Nasional (BN) sendiri yang akan membuat usul undi tidak percaya kepada beliau dalam sesi sidang Parlimen kali ini. Bagaimanapun dua ahli Parlimen Parti Maju Sabah (SAPP) tidak hadir pada sidang semalam kerana didakwa diugut pihak tertentu melalui khidmat pesanan ringkas (SMS). Usul tersebut mendapat sokongan 129 undi setuju dan 78 membantah setelah dibuat undi belah bahagian. Sokongan terhadap usul tersebut tidak memberi gambaran jelas bahawa ia merupakan keputusan rakyat kerana wakil rakyat BN mengundi berdasarkan sokogan kepada pemimpin mereka bukan untuk kepentingan rakyat.

"Wakil rakyat BN ketika itu menjadi ahli Parlimen kepada BN dan bukan bertindak membuat keputusan atas kapasiti mereka sebagai wakil rakyat kawasan mereka. Sekiranya hendak mencapai keputusan yang adil terhadap usul tersebut kerajaan sepatutnya memberi tempoh seminggu sebelum usul itu dibentangkan. Wakil rakyat pula perlu membuat referendum di kawasan mereka. Keputusan pungutan suara itu yang perlu dibawa oleh wakil rakyat tersebut ke sidang Dewan Rakyat dan menjadikan keputusan tersebut sebagai undi ahli parlimen kepada usul kenaikan harga minyak dan harga barang"

Keputusan tersebut lebih adil demi menjaga kepentingan rakyat bukan undi menyokong berdasarkan mereka sebagai wakil rakyat BN dan menjadi peraturan tetap menyokong apa yang diputuskan kerajaan walaupun dalam hati di kalangan mereka ada yang tidak bersetuju. Oleh yang demikian keputusan undi terhadap usul kenaikan harga minyak dan barangan merupakan keputusan politik Abdullah bukan usul kepentingan rakyat. Selain itu rakyat mempersoalkan kenapa usul tersebut dibentangkan selepas kerajaan menaikkan harga minyak?

Sekiranya benar kerajaan BN amat prihatin dengan rakyat sepatutnya usul tersebut dibentangkan sebelum kerajaan memutuskan untuk menaikkan harga minyak. Sebagaimana yang disuarakan Presiden PAS, Dato' Seri Tuan Guru Abdul Hadi Awang yang menyifatkan usul tersebut sudah terlambat. Sambil melahirkan kekesalan terhadap usul yang lewat itu beliau berkata bahawa kerajaan sepatutnya membawa usul itu sebelum pengumuman harga minyak dibuat (4 Jun).

"Dewan Rakyat jadi 'rubber stamp' untuk mengiakan apa sahaja yang diputuskan oleh kerajaan sedangkan sebarang keputusan kerajaan ini sebenarnya keperitannya ditanggung oleh rakyat," ujar Presiden PAS itu. Sebelum itu Ketua Menteri Pulau Pinang, Lim Guan Eng (DAP Bagan) turut menyelar tindakan kerajaan mengemukan usul tersebut selepas kerajaan menganiaya rakyat terlebih dahulu dengan kenaikan harga minyak. "Langkah kerajaan ini sebenarnya menghumban rakyat kepada kemiskinan yang melampau, malah pendekatan yang dikatakan untuk mengurangkan beban rakyat ini adalah satu langkah 'ad hoc' dan terdesak.

"Kenapa tidak kerajaan memikirkan langkah ini dahulu sebelum mengumumkan kenaikan harga minyak," ujarnya. Usul tersebut dibentangkan selepas sesi soal jawab dan dibahaskan selama enam jam. Undi belah bahagian dibuat pada pukul 7 malam. Rakyat bagaimanapun tidak mendapat maklumat penuh berhubung perbahasan tersebut sama ada ucapan wakil rakyat kerajaan atau pembangkang untuk dinilai tentang kebenaran berpihak kepada kerajaan ataupun pembangkang. Kalau kerajaan boleh mengadakan siaran langsung temu bual Pengerusi Petronas malah dibuat siaran ulang tayang berkali-kali sama ada televisyen kerajaan mahupun swasta sepatutnya sebagai memenuhi kepentingan rakyat perbahasan tersebut sebaiknya disiar di televisyen walaupun secara rakaman.

Bagaimanapun rakaman tersebut tidak perlu diedit atau dipotong mana-mana hujah yang kuat daripada pihak pembangkang. Apakah kerajaan bersedia berbuat demikian? Jika kerajaan bersedia berbuat demikian barulah usul tersebut boleh didakwa untuk kepentingan rakyat sebaliknya bukan dimanipulasi demi survival politik Abdullah sebagaimana laporan media tempatan lebih kepada keputusan undi usul itu tetapi bukan kandungan perbahasan. BN mempunyai 140 ahli Dewan Rakyat, termasuk dua timbalan yang dipertua, sementara pembangkang mempunyai 82 wakil.

Empat ahli Parlimen pembangkang yang tidak hadir antara yang dikenal pasti ialah Nurul Izzah Anwar (PKR-Lembah Pantai), Gobind Singh Deo (DAP-Puchong) dan Chow Kon Yeow (DAP-Tanjong). Ahli Parlimen BN yang tidak hadir seramai 11 orang termasuk dua wakil BN daripada SAPP, Chua Soon Bui (Tawau) dan Eric Enchin Majimbun (Sepanggar). INCREASINGLY, more and more people are turning towards herbal supplements as a preventive and curative remedy for their ailments. However, have you ever wondered whether the herbal supplements you buy contain the right ingredients or whether the contents in the bottle are the same as the label’s claim? Also, the big price difference between different brands of the same herbs. Are they of similar quality? These are some of the problems you will face when you buy herbal products. The following are some of the common problems with herbal supplements: too little or no active ingredients; wrong ingredients; contamination; unexpected ingredients (“spike products”). By being aware of the problems, you will be more careful when selecting products to buy.

(1) Too little or no active ingredients
A product that contains less of the active ingredient(s) than the label indicates or is devoid of that ingredient(s) is unlikely to perform as expected. This may happen because the ingredient is expensive and the manufacturer puts in less of it. Or, the manufacturer buys a cheaper material, which may or may not be up to standard. Although verifying material quality should be standard practices - especially when materials are purchased at unusually low prices - many manufacturers don’t bother to check or do not have the equipment or the know-how to check.

(2) Wrong ingredients
Non-herbal products rarely contain the wrong ingredients, but herbals commonly do. Specifically, herbal products contain the wrong plant part (leaf instead of root) or wrong species of plant. In addition, a herb or herbal extract should contain specific plant chemicals in the amounts shown to be effective in clinical trials. Unfortunately, growing, harvesting and processing conditions can easily affect these chemicals. If for example, the wrong species of herb or the wrong plant part is used or if the herb is harvested at the wrong time of the year, the ingredient may be ineffective.

(3) Contaminated ingredients
Besides wrong ingredients, herbal products may contain chemicals or other ingredients that don’t belong there. Possible contaminations include pesticides, micro-organisms and heavy metals (mercury, lead, arsenic). Some contaminants can be toxic or carcinogenic, which can be detrimental to health if taken on a regular basis.

(4) Unexpected (spiked) ingredients
Some herbal supplements are spiked with ingredients not listed on their labels to enhance the effect of the product. Spiking is most common in products where consumers expect an immediate effect. For example, ginseng, which is usually taken to increase vitality, may be spiked with caffeine, which is a stimulant. Some products are occasionally spiked with prescription drugs.

(5) How to choose herbal supplements
The quality of herbal products begins with the quality of the raw materials. If you put garbage in, garbage comes out. Many companies try to cut corners and save a few cents by using inexpensive raw materials. Example, crude extracts are generally inexpensive and their quality can vary from batch to batch even from the same supplier. Therefore, in order to guarantee consistency of the quality of the herbal products, look for a product that contains standardised extracts, even though they are expensive. The reason for using standardised extracts is to ensure that all herbal products contain the same amount of a plant’s biologically active compound. Some raw material suppliers take advantage of the fact that very few manufacturers carry out tests on herbal raw materials. These manufacturers rely solely on the supplier’s Certificate of Analysis (CoA), which can be a problem. Naib Presiden Parti Keadilan Rakyat (KeADILan), Azmin Ali (KeADILan Gombak) hanya menyatakan bahawa semua pihak perlu 'tunggu dan lihat' berhubung bila usul undi tidak percaya kepada Perdana Menteri, Dato' Seri Abdullah Ahmad Badawi. Semasa ditemui di Dewan Rakyat pagi tadi Azmin bagaimanapun menyatakan soal undi tidak percaya itu telah dibincangkan dalam Pakatan Rakyat. Beliau juga menyatakan bahawa usul itu perlu mengikut prosedur yang ditetapkan Dewan Rakyat iaitu antaranya melalui proses dengan dua minggu notis atau penggunaan peraturan urusan mesyuarat perkara 18 (1).

Namun semasa ditanya mengenai bila ia akan dibawa ke Dewan Rakyat, beliau menyatakan bahawa 'ini soal strategi'. P/s: The slideshow above shows the latest collection of my Transformers Animated toys which is the Bulkhead leader class. As we'll know, Bulkhead is the strongest of all Autobots. Despite his capability of destroying and ripping off Decepticon limbs, he's also can be classified as the most cunning Autobots of all and in fact, he can paints art, plays with the birds, views the earth's nature cautiously and most of the time likes to hang out with Sari (a fun and loveable toddler that always hang up with Bumblebee and Bulkhead)...HeHeHe!!! Anyway, I wasn't gonna take it at the first place during my visit to the toyworkers shop at Subang Square on the last Saturday night, but when I played with the toy sample, I did notice that this figure was quite a playable toy and in fact it has a lot of sound effects and lights which indeed made me quite hard to resist it... HeHeHe!! So, eventually I bought it with some agreement with my wife (she's quite fussy on buying this stuff frequently...HeHeHe!!) and with the best price in town, I'd say that, they were selling me this figure with much lower price than the Hasbro normal price. I've asked James (owner of the shop) on how he got the action figures especially for the Transformers figures with the lowest price all the time, he was just smiling at me at said: "Haiya, wa jual murah pun u tak mo ka?" So, that was the storyline and without further due, I snapped the figure and paid less than RM5 than the usual price. 'OK la tu!!!'...HeHeHe!! Overall, I'd say that this figure is the best figures of all (Transformers Animated toy lines) and no wonder there are lots of Transformers gigs out there searching for this figure seriously with no remorse...

Police will be calling up Malaysia Today editor Raja Petra Kamaruddin to investigate allegations in his recent statutory declaration on purported facts related to the murder of Altantuya Shaariibuu. Inspector-General of Police Tan Sri Musa Hassan said the three individuals named in the document filed on June 18 would also be called up.

In the declaration, Raja Petra claimed that the trio - one of them a prominent woman - were present at the scene during the murder of the Mongolian translator in October 2006. Copies of the two-paged declaration together with the identity of the trio have been posted on various blog sites. In the document, Raja Petra said he was “reliably informed” of these allegations. Musa said the matter could be sub judice as the Altantuya murder case was still being heard.

He also said Raja Petra must be “brave enough to face the consequences if he is bold enough” to make the allegations. Meanwhile, the Attorney-General’s Chambers has lodged a police report against Raja Petra over the statutory declaration. Attorney-General Tan Sri Abdul Gani Patail said the allegations were “highly defamatory” and if found untrue, those making the allegations would have to face the consequences.

“We want to investigate because we want the truth. As far as I am concerned, we have to look at it seriously.” “If it’s true, we will act accordingly. If not, the writer will be investigated,” he said, adding that the report was lodged in Putrajaya on Saturday. Raja Petra said he expected to be called up. My informer states that Acting Colonel Aziz Buyong was the person who placed the C4 on various parts of Altantuya’s body while being witnessed by Datin Seri Rosmah Mansor and Norhayati.

"It's mindboggling!" - That's how Raja Petra Kamarudin's statutory declaration alleging that Deputy Prime Minister Najib's wife was at the murder scene of Mongolian national Altantuya Shaariibuu was described today. An aide to Najib Abdul Razak also said they were aware of this latest claim made by Raja Petra, who also runs the 'Malaysia Today' website."At the moment, we are looking into it. This is a very mind-boggling statutory declaration," said the aide when contacted. The latest allegation hurled at Rosmah Mansor was made by well-known blogger Raja Petra Kamarudin via a statutory declaration (below) signed at the Kuala Lumpur High Court on Wednesday. The aide however refused to comment if any action could be taken against Raja Petra. Najib and Rosmah (left) have repeatedly denied they are linked to the killing of Altantuya, describing the widely-known allegations was nothing more than ‘slander and concocted stories’.

In his latest bombshell, Raja Petra accused Rosmah as among three individuals who were present when Altantuya was murdered on October 19, 2006. "I have been reliably informed that between about 10pm on October 19, 2006 and early hours of the following day, the night Altantuya Shaariibuu was murdered, three other people were also present at the scene of crime," he said, according to his two-page statutory declaration. He named the two other individuals as one acting colonel Aziz Buyong, who is described as ‘a C4 expert’ and the latter’s wife, known only as Norhayati, who is also said to be Rosmah’s aide de camp.

‘A crime not to reveal’

Altantuya’s body is alleged to have been blown up with C4 explosives at a secondary forest in Puncak Alam, Shah Alam. The murder trial is currently ongoing at the Shah Alam High Court. "My informer states that Aziz was the person who placed the C4 on various parts of Altantuya’s body witnessed by Rosmah and Norhayati," Raja Petra claimed in the document. "I make this statutory declaration because I have been reliably informed about the involvement of these three people who have thus far not been implicated in the murder nor called as witnesses by the prosecution in the ongoing trial at the Shah Alam High Court.

"I also make this statutory declaration because I am aware that it is a crime not to reveal evidence that may help the police in its investigation of the crime," read the document, which was first posted on the bigdogdotcom blog run by another blogger. Raja Petra, contacted by Malaysiakini, has confirmed the content of the document. He further alleged that he has also been ‘reliably informed’ that Prime Minister Abdullah Ahmad Badawi knows of Najib's (right) wife alleged involvement.

"Abdullah has received a written report from military intelligence confirming what I have revealed and this report was subsequently handed over to his son-in-law Khairy Jamaluddin for safekeeping," he said. Apart from Abdullah and Khairy, Raja Petra claimed "one of the (Malay) Rulers" has also been briefed about the matter and is fully aware of the allegation. He said he has agreed not to reveal their names other than mention that the prime minister and his son-in-law have been given a copy of the military intelligence’s report.

Police inaction over report

"The purpose of this statutory declaration is to urge all these parties who have been duly informed and have knowledge of this matter to come forward to reveal the truth so that the police are able to conduct a proper and thorough investigation into the murder of Altantuya. "And I make this solemn declaration conscientiously believing the same to be true and by virtue of the provisions of the Statutory Declaration Act, 1960," he said in his declaration.
In the phone interview, Raja Petra explained why he did not lodge a police report on the latest allegation which could lead to a fresh police probe on the Altantuya murder. The blogger said since there was no action over a police report he had lodged in a separate case in 2001 when he was allegedly beaten up by a high-ranking policeman, "I am not bothered in making a police report".

When asked why the document was posted elsewhere instead of his own 'Malaysia Today' site, he retorted: "Why must it be published on my site?" Raja Petra was called in for police questioning early last month over an article titled ‘Let’s send the Altantuya murderers to hell’ in which he implicated Najib and Rosmah in the high-profile murder case. A close aide to Najib, political analyst Abdul Razak Baginda and two police special operations force personnel have been charged with the murder of the Mongolian national. Mungkin ada pemimpin yang paling tidak selesa menunggu detik-detik persidangan kedua Parlimen bakal berlangsung mulai esok. Resahnya bukan sekadar mandi tak basah, makan tak kenyang, sebaliknya silap hari bulan segalanya yang dipegang selama ini terlepas. Inilah debaran yang mungkin sedang dihadapi Perdana Menteri, Dato' Seri Abdullah Ahmad selepas liku-liku politiknya hampir terpadam pada 8 Mac lalu.

Biar pun Menteri di Jabatan Perdana Menteri, Dato' Seri Nazri Aziz memberi jaminan tiada usul tidak percaya terhadap Abdullah pada persidangan yang bermula esok, namun ia tetap ditunggu dengan penuh debaran. Pakar Undang-Undang Perlembagaan Universiti Islam Antarabangsa Malaysia (UIA), Prof Dr. Abdul Aziz Bari berkata, sejarah membuktikan undi tidak percaya telah membawa kejatuhan tiga ketua kerajaan negeri sebelum ini. Katanya, usul undi tidak percaya telah berjaya pada 1966 di Sarawak, pada 1976 di Selangor dan tahun 1977 di Kelantan sehingga membawa kepada kejatuhan Menteri Besar dan Ketua Menteri.

Katanya paling akhir berlaku di Kelantan di mana undi tidak percaya telah membawa kepada kejatuhan Datuk Mohamad Nasir sebagai Menteri Besar sehingga kerajaan Barisan Nasional berkuasa setahun kemudian. "Biar pun ada pihak yang menolak undi tidak percaya kemugkinan dibawa pada persidangan kali ini, ramai tidak sedar tiga ketua kerajaan pernah jatuh melalui undi tidak percaya yang dibawa ketika itu. "Oleh itu kenyataan Speaker Dewan Rakyat sebelum ini seolah-olah mahu menyelamatkan kerajaan yang sudah terkepung dianggap agak terlewat," katanya pada Wacana 100 Hari Pemerintahan Pakatan Rakyat di Balai Islam, malam tadi.

Mesyuarat Kedua, Penggal Pertama, Parlimen Ke-12 (2008) Dewan Rakyat bersidang mulai esok sehingga 15 Julai depan, manakala Dewan Negara pula 15 Julai hingga 24 Julai 2008. Baru-baru ini Yang Dipertua Dewan Rakyat, Tan Sri Pandikar Amin Mulia dilaporkan berkata, sebarang usul perlu melalui Peraturan Mesyuarat yang dibenarkan oleh Speaker. Rabu lalu, Presiden Presiden Parti Maju Sabah (SAPP), Dato' Yong Teck Lee mengumumkan parti itu hilang kepercayaan kepada terhadap kepimpinan Perdana Menteri dan memberitahu akan menyokong usul tidak percaya terhadapnya.

SAPP mempunyai dua ahli parlimen iaitu ahli Parlimen Tawau, Chua Soon Bui dan ahli parlimen Sepanggar, Datuk Eric Majimbun. Mereka mengesahkan akan bertindak mengikut arahan parti. Berasaskan perkiraan itu kemungkinan besar bilangan ahli parlimen BN akan susut kepada 138 kerusi dan Pakatan Rakyat berpeluang bertambah menjadi 84 kerusi. Dr. Abdul Aziz berkata, tidak timbul notis 14 hari dikemukakan sebelum sesuatu usul dibentang pada persidangan parlimen sebagaimana difahami banyak pihak sebelum ini. Menurutnya ada jalan pintas yang boleh dibuat tanpa melalui notis usul sekiranya ada kekuatan untuk menumbangkan kerajaan BN yang ada sekarang.

Lagi pun katanya, dalam banyak keadaan kerajaan jarang mengikut sepenuhnya undang-undang biar pun secara jelas termaktub dalam perlembagaan negara. Beliau juga berkata, keberkesanan segala janji-janji Pakatan Rakyat hanya dapat ditunaikan sepenuhnya apabila dapat menguasai kerajaan persekutuan. "Oleh itu peluang yang ada hanya datang sekali. Ahli-ahli politik perlu berani mengambil risiko sekiranya mahu kepemimpinan negara bertukar dalam tempoh yang lebih singkat tanpa perlu menunggu 16 September depan, ujarnya. Beliau juga berkata, sembilan negeri yang mempunyai Sultan sudah dijelaskan di sisi undang-undang iaitu ketua kerajaan mesti dilantik dari kalangan orang Melayu biar parti mana sekali pun memperolehi majoriti.

"Kedudukan orang Melayu pada perlembagaan sudah jelas dan ia tidak berubah. Biar pun Ummo jatuh, orang Melayu tetap tidak berubah. Yang jatuh Umno dan bukannya kedudukan orang Melayu," ujarnya. Anggota parlimen Machang, Saifuddin Nasution Ismail berkata, hak-hak orang Melayu termasuk bahasa, agama Islam dan keistimewaan lain tetap dipertahankan Pakatan Rakyat. Felipe Massa led a Ferrari one-two to win the French Grand Prix yesterday and take the lead in the Formula One championship for the first time. Massa’s third victory of the season, and eighth of his career, made the 27-year-old Sao Paulo driver the first Brazilian to lead the standings since the late triple champion Ayrton Senna in 1993. Team mate Kimi Raikkonen, the world champion who won at Magny-Cours last year, led from pole but was overtaken by Massa just after the halfway mark when his Ferrari slowed with a broken exhaust.

Massa took the chequered flag 17.9 seconds clear of Raikkonen on an overcast and damp afternoon at the circuit in the heart of rural France. “I didn’t expect that, sometimes you need a little bit of luck,” said Massa after Ferrari’s third one-two of the season. “The championship is still 100 percent open and we still have many races to go. “It’s nice but my dream is not to lead the championship, it is to win the championship. And I’m going to do my best to achieve that.” Raikkonen could not hide his disappointment but, with his car almost stopping in the closing stages, accepted the second place.

“I’ll take the eight points and it looks much better in the championship,” he said. Kesihatan merupakan sesuatu yang amat penting dalam kehidupan manusia. Tanpa kesihatan yang baik maka seseorang manusia itu tidak akan mampu untuk membina masa depan yang cemerlang. Oleh kerana manusia terdiri daripada dua unsur kejadian yang utama iaitu rohani dan jasmani maka seseorang itu dikatakan sihat jika memiliki kesihatan dari kedua-dua aspek ini. Tidak ada seorang pun yang boleh menolak kenyataan bahawa manusia perlu kepada kesihatan yang sempurna dari sudut rohani dan jasmani.

Oleh yang demikian manusia berlumba-lumba mencari kaedah serta amalan tertentu untuk mengekal dan mempertingkatkan tahap kesihatan masing-masing. Mereka sanggup untuk berbelanja besar demi memastikan matlamat kesihatan tercapai. Dalam masa yang sama pula pelbagai pusat rawatan tumbuh bagaikan cendawan selepas hujan dengan menawarkan kaedah serta konsep rawatan yang berbeza-beza. Namun dalam kepesatan dan kebangkitan pelbagai pusat rawatan, didapati kebanyakannya lebih cenderung kepada rawatan yang berbentuk jasmani semata-mata. Amat jarang kita dapati adanya penawaran rawatan untuk penyakit yang berbentuk rohani

Perubatan Islam yang menawarkan rawatan rohani dan jasmani berteraskan al-Qur'an dan al-Sunnah, berkonsepkan "al-dua' silah al-mukmin" doa adalah senjata bagi orang-orang beriman bahkan firman Allah s.w.t:

Dan kami turunkan dari Al Quran suatu yang menjadi penawar dan rahmat bagi orang-orang yang beriman dan Al Quran itu tidaklah menambah kepada orang-orang yang zalim selain kerugian - al-Isra':82

Sudah lama dipraktikkan semenjak zaman Rasulullah s.a.w dan kemudiannya diwarisi dari zaman-berzaman oleh Salafussoleh sehinggalah kepada para ulama mutaakhirin. Kemampuan perubatan islam dalam merawat pelbagai penyakit rohani dam jasmani tanpa mengabaikan perubatan konvesional telah mendapat tempat dalam masyarakat islam di Malaysia. Bahkan kadang-kadang penyakit yang sukar diubati sekalipun disembuhkan oleh Allah hanya melalui pembacaan al-Qur'an, mandian al-Qur'an dan air yang telah didoakan.

Perubatan islam sama-sekali tidak menolak kepentingan perubatan moden atau konvensional yang banyak berjasa merawat pelbagai penyakit yang berkaitan dengan jasmani. Kewujudan perubatan islam adalah semata-mata untuk menyempurnakan keperluan kesihatan manusia daripada sudut rohani. Jika sekiranya perubatan konvesional dan perubatan islam dapat bergabung dalam memberi khidmat kepada masyarakat maka ianya seolah-olah momentum yang cukup kuat dan sempurna kepada kesihatan masyarakat Malaysia.

Oleh itu, diharap kepada para sahabat sekalian dapat memberi ruang kepada perubatan Islam untuk berkongsi ilmu dan pengalaman dalam bidang masing-masing demi kesejahteraan umat sejagat melalui Seminar Perubatan Islam yang akan dianjurkan oleh PKIKWSP dengan kerjasama Ar Rijal Trading .

Usul undi tidak percaya terhadap Perdana Menteri, Dato' Seri Abdullah Ahmad Badawi tetap akan dibawa ke Dewan Rakyat meskipun tidak akan dibentangkan pada hari Isnin seperti yang digembar-gemburkan sesetengah pihak. Setiausaha Agung PAS, Dato' Kamarudin Jaffar berkata pihaknya menafikan ada dakwaan usul bakal dibuat pada hari tersebut namun semua parti komponen Pakatan Rakyat termasuk daripada PAS, KeADILan dan DAP akan hanya berbuat demikian pada masa yang difikirkan sesuai.

"Hari Isnin ini 'sah' tidak ada tetapi selepas hari itu atau pada-pada bila-bila masa kita pasti akan bentangkan usul tersebut. "Ya...pada tahun ini kita akan usulkan undi tidak percaya setelah berbincang dan mendapat persetujuan sepakat dengan semua parti komponen Pakatan Rakyat," katanya ketika dihubungi Harakahdaily bagi mendapat reaksi segara berhubung isu terbabit. Beliau merupakan ahli Parlimen berpengalaman turut menjelaskan sesuatu usul seperti undi tidak percaya perlulah diberikan notis awal terlebih dahulu kepada Parlimen dan tidak boleh dikategorikan sebagai usul tergempar yang boleh diberi notis selama 24 jam.

Dalam pada itu itu, beliau menyatakan pandangan senario terkini merupakan antara kemuncak krisis ketidak-percayaan rakyat terhadap kepimpinan Abdullah yang selama ini dilihat lemah dan tidak sensitif kepada masalah yang menghimpit rakyat. Katanya undi tidak percaya parti kompenen Barisan Nasional (BN) seperti Parti Maju Sabah (SAPP) merupakan permulaan yang penting dalam mencorakkan politik negara yang dilihat terumbang-ambing pasca 8 Mac lalu.

"Selepas 100 hari Abdullah dilihat makin lemah dan tidak berupaya untuk mengurus tadbir negara dengan baik khususnya dalam hal ehwal kewangan dan ekonomi yang juga berkait rapat dengan krisis kenaikan harga minyak. "Ini tidak termasuk kucar-kacir dan pecah-belah yang berlaku pada Umno yang tidak memungkinnya menjadi parti contoh dalam komponen BN dan kepada negara amnya," katanya yang juga Ahli Parlimen Tumpat. Justeru tindakan yang diambil oleh SAPP dianggap tepat dan wajar dicontohi oleh parti-parti komponen BN yang lain. BN: No ACTioN AGaiNsT SAPP-"DoLaH Is STiLL IN THe STaTe OF DeNiaL"...

Profesor Dr Abdul Aziz Bari dari Universiti Islam Antarabangsa Malaysia (UIAM) mengingatkan parti-parti politik supaya tidak bertindak membuta tuli dalam menghadapi kemelut politik negara dengan membubarkan Parlimen atau mengisytiharkan darurat. Beliau menegaskan, Yang di-Pertuan Agong mempunyai peranan yang sangat penting di dalam mententeramkan keadaan politik yang tidak menentu sekarang.

Beliau berkata demikian ketika mengulas kemungkinan apa yang akan berlaku, selepas Parti Maju Sabah (SAPP) yang dipimpin Dato' Yong Teck Lee mengisytiharkan partinya akan membawa atau menyokong undi tidak percaya terhadap Perdana Menteri, Dato Seri Abdullah Ahmad Badawi dalam sidang Parlimen yang akan bermula minggu depan. Ekoran tindakan parti komponen Barisan Nasional (BN) itu, pelbagai spekulasi telah timbul. Ini termasuklah tindakan mengadakan pilihan raya mengejut oleh BN untuk menyelamatkan dirinya.

Selain itu, tegas beliau, ada yang bimbang bahawa perisytiharan darurat akan dibuat bagi mengelakkan kejatuhan kerajaan BN melalui undi tidak percaya di parlimen. "Oleh kerana kemungkinan-kemungkinan itulah maka Perlembagaan secara idealnya memberi ruang kepada Yang di-Pertuan Agong untuk bertindak bebas dari nasihat atau pengaruh kerajaan yang memerintah," tegas Aziz. Beliau yang juga pakar Perlembagaan, mengingatkan bahawa kedudukan dan peranan Yang di-Pertuan Agong sebagai Raja Berperlembagaan tidak harus disamakan dengan cop getah yang perlu melaksanakan apa sahaja yang diminta oleh kerajaan. "Raja berperlembagaan sebenarnya lebih merujuk kepada seorang raja yang bertindak selaras dengan tuntutan dan semangat demokrasi bukan mengikut nasihat membuta tuli", tambah beliau.

Mengenai pilihan raya mengejut Aziz berkata ia hanya boleh dilakukan sekiranya Yang di-Pertuan Agong berkenan dengan permohonan Perdana Menteri untuk membubarkan Dewan Rakyat. Aziz berkata di bawah Perlembagaan kuasa itu adalah kuasa baginda dan Perdana Menteri tidak boleh memaksa Yang di-Pertuan Agong. "Perkara 40(2)(b) Perlembagaan Persekutuan dengan jelas menyatakan bahawa ia adalah kuasa budibicara Yang di-Pertuan Agong," tambahnya lagi. Dua minggu lalu Aziz berkata bahawa di dalam senario sekarang adalah tidak wajar untuk Yang di-Pertuan Agong membubarkan dewan bagi membolehkan pilihan raya semula diadakan. Beliau menjelaskan, meskipun kuasa itu kuasa budibicara baginda diberi tanggungjawab untuk menilai keadaan dan mempastikan bahawa kepentingan negara dan rakyat mengatasi segala-galanya. "Inilah sebabnya mengapa Suruhanjaya Reid meminta Yang di-Pertuan Agong melihat pengalaman negara-negara Komanwel yang lain," tegas beliau. Aziz menjelaskan di dalam keadaan sekarang pembubaran dewan adalah tidak perlu kerana dua sebab.

"Yang pertama kita sudah mendengar hasrat untuk membawa usul undi tidak percaya di parlimen. Dengan demikian Yang di-Pertuan Agong mesti menunggu sehingga usul itu dikemukakan dan melihat hasilnya. Sekiranya Yang di-Pertuan Agong berkenan membubarkan dewan maka baginda akan dilihat menyebelahi kepentingan Barisan Nasional dan ini tidak selaras dengan ideal Perlembagaan yang mahukan baginda bebas dari politik dan melindungi proses Perlembagaan," tegas Aziz.

Sebab yang kedua, bahasnya, wujudnya potensi pembentukan kerajaan baru tanpa melalui pilihan raya. Beliau menjelaskan sama ada melalui undi tidak percaya atau lompat parti, sebuah kerajaan baru sebenarnya boleh dibentuk. "Cara ini jelas lebih murah dan lebih menjimatkan masa. Lagipun pilihan raya baru sahaja diadakan," ujarnya. Bagaimanapun, Aziz berasa ragu sekiranya pilihan raya adalah satu pilihan yang sesuai ekoran kenaikan harga minyak kerana isu itu menyebabkan kerajaan yang memerintah sekarang tidak lagi popular.

Mengenai pemerintahan darurat di bawah Perkara 150, Aziz berkata ia adalah tidak baik kerana krisis politik yang ada sekarang boleh ditangani melalui proses dan prosedur biasa yakni undi tidak percaya dan seterusnya. "Dalam soal ini Yang di-Pertuan Agong mesti menolak nasihat untuk mengisytiharkan darurat kerana ia akan menyebabkan Perlembagaan digantung dan kerajaan yang ada diberi kuasa untuk membuat undang-undang tanpa ke parlimen. TEASER 100: "CaT's CONSPiRaCY? I ReaLLY DoN'T GiVe A DaMN"....HeHeHe!!

'MeLiHaT KeMunGKiNaN BeRLaKu UnDi TiDaK PeRCaYa'...

Sekiranya apa yang dikatakan oleh Parti Maju Sabah (SAPP) semalam untuk membuat usul undi tidak percaya di parlimen adalah benar, ia merupakan satu sejarah dalam senario politik tanah air.

Apa itu usul undi tidak percaya?
Seperti yang diketahui umum, usul tidak percaya tidak pernah berlaku di dalam Parlimen Malaysia, walaupun telah berlaku di negeri Sarawak pada akhir tahun 60-an dalam kes Stephen Kalong Ningkan. Pun begitu, dalam kes Sarawak tersebut usul tersebut tidak dibuat di dalam Dewan Negeri, maka mahkamah menyatakan bahawa usul tidak percaya tersebut tidak sah. Mahkamah dalam kes tersebut menyatakan bahawa, untuk menjadikan sesuatu undi tidak percaya tersebut sah, ia hendaklah dilakukan secara formal di dalam Dewan Negeri.

Berdasarkan keputusan kes di Sarawak ini maka, semestinyalah undi tidak percaya tersebut dibuat di Parlimen, sekiranya terdapat pihak yang mahukan Perdana Menteri secara sah dianggap hilang kepercayaan. Tetapi dalam prinsip perlembagaan yang asas, keputusan dalam kes Stephen Kalong Ningkan tersebut bukanlah satu-satunya cara yang membolehkan seorang Perdana menteri atau pemerintah hilang kepercayaan Dewan. Contohnya, dalam kes yang berlaku di Sabah, kes Tun Datu Amir Kahar. Mahkamah menentukanbahawa, tanggapan tidak percaya boleh terjadi bilamana, bilangan mereka yang menyokong pemerintah menjadi lebih kecil bilangannya daripada mereka yang menentang.

Dalam kes Datu Amir Kahar ia dikenali sebagai ‘extraneous circumstances’. Dato' Pairin Ketingan yang telah hilang beberapa orang rakan parti dan menjadikan parti majoriti dalam Dewan Undangan Negeri Sabah berkurangan dan gagal membentuk majoriti, menyebabkan Pairin telah meletakkan jawatan. Datu Amir Kahar pada ketika itu merupakan Menteri Pertanian dan Perikanan Sabah memohon kepada Mahkamah untuk mengekalkan jawatannya, walaupun Dato' Pairin telah meletakkan jawatan. Mahkamah memutuskan bahawa, perletakan jawatan Pairin Kitingan merupakan perletakan jawatan keseluruhan kabinet, bukannya perletakan jawatan secara berseorangan, dan Datu Amir Kahar sebenarnya bukan lagi seorang menteri. Walaupun undi tidak percaya bukanlah isu utama dalam kes tersebut, tetapi mahkamah telah membuat satu prinsip penting dalam perkara undi tidak percaya ini, iaitu, undian secara formal di dalam Dewan bukanlah satu-satunya cara melahirkan undi tidak percaya.

"Extraneous Circumstances"
Dalam "extraneous circumstances" ini, tidak perlu lagi undi tidak percaya secara formal seperti yang diputuskan dalam kes Stephen Kalong Ningkan di Sarawak itu. Sekiranya ramai penyokong pemerintah telah beralih parti, dan parti yang dulunya minoriti telah membentuk majoriti, maka ini dengan sendiri menjadi "extraneous circumstances" dan boleh dikatakan sebagai undi tidak percaya seperti di dalam kes Tun Datu Amir Kahar di Sabah itu.

Dalam keadaan lain, undi tidak percaya juga mungkin berlaku sekiranya pihak pemerintah gagal mendapatkan kepercayaan. Contohnya, bila para penyokong kerajaan meminta para ahli Dewan Rakyat memberikan sokongan atau kepercayaan kepada pucuk pimpinan, tetapi permintaan tersebut gagal mendapat sokongan atau kepercayaan yang dimaksudkan, maka keadaan ini juga boleh dikatakan sebagai undi tidak percaya. Begitu juga dalam keadaan di mana pihak kerajaan telah tidak dapat meluluskan rang undang-undang atau polisi besar negara, kerana gagal mendapatkan 2/3 majoriti pada peringkat bacaan kedua dan ketiga sesuatu rang undang-undang atau telah ditentang hebat mengenai polisi besar tersebut, maka ini juga menjadi satu situasi yang mana undi tidak percaya telah berlaku. Senario sekarang ini memperlihatkan hilangnya kepercayaan salah satu parti komponen, bukannya majoriti ahli Dewan Rakyat seperti yang disebutkan oleh Perlembagaan.

Namun begitu, ini adalah bunga-bunga atau bibit-bibit yang kelak akan menjelaskan pandangan sesetengah parti komponen BN. Mungkin di dalam dada-dada akhbar pada hari ini memberikan biodata dan kronologi penglibatan Dato' Yong Teck Lee, apa yang harus pembaca akhbar lihat ialah, kesungguhan Parti tersebut untuk menyuarakan ketidakpercayaan mereka terhadap pucuk pimpinan BN.

Apa yang perlu dilakukan Perdana Menteri sekiranya undi tidak percaya ini berlaku?
Menurut peruntukan Perlembagan Persekutuan, Perkara 43(4), Perdana Menteri hendaklah meletakkan jawatan, dan seorang Perdana Menteri baru akan dilantik oleh Yang di-Pertuan Agong tanpa perlu menjalankan satu pilihan raya umum yang baru. Perletakan jawatan Perdana Menteri dalam keadaan ini merupakan juga perletakan jawatan kesemua Jemaah Menteri yang telah dilantik semasa pemerintahan Perdana Menteri tersebut, seperti yang telah diputuskan dalam kes Datu Amir Kahar di Sabah.

Jika Perdana Menteri pasrah dan redha dengan apa yang berlaku, maka proses ini agak mudah, yang mana Yang di-Pertuan Agong akan melantik seorang yang pada pandangannya akan beroleh sokongan majoriti ahli Dewan Rakyat, sebagaimana peruntukan perkara 43(2) Perlembagaan Persekutuan. Dan seterusnya Perdana Menteri baru tersebut akan menasihatkan Yang di-Pertuan Agong untuk melantik Jemaah Menteri yang baru. Pilihan kedua yang ada sebagaimana peruntukan Perlembagaan sekiranya PM tidak mahu meletakkan jawatan, maka beliau boleh menasihatkan Yang di-Pertuan Agong untuk membubarkan Dewan Rakyat.

Mungkin ini yang akan dilakukan oleh Perdana Menteri yang masih di dalam "state of denial" yakni tidak dapat menerima undi tidak percaya tersebut. Sekiranya Dewan dibubarkan, maka, satu pilihan raya umum perlu dijalankan bagi melantik perwakilan yang baru. Satu lagi proses membuang undi dan membuang duit akan berlaku. Apa akan berlaku sekiranya Perdana Menteri gagal melakukan salah satu daripada dua pilihan yang diberikan oleh Perlembagaan?
Jawapannya agak ringkas, iaitu kegagalan tersebut adalah tidak berperlembagaan tetapi kesannya memang besar. Namun kesannya ialah, ia akan mengundang bahaya pada negara, apabila suasana politik menjadi tegang dan berbagai kemungkinan yang lebih teruk boleh berlaku. 'SPeaKeR TiaDa KuaSa SeKaT UnDi TaK PeRCaYa'...

Speaker Dewan Rakyat sebenarnya tidak mempunyai kuasa untuk menyekat usul undi tidak percaya yang dikemukakan di Parlimen. Perkara ini ditegaskan oleh Profesor Dr Abdul Aziz Bari, pakar Perlembagaan ketika dihubungi ekoran pendapat yang menyatakan bahawa Speaker mempunyai kuasa untuk menolak usul tersebut selain beberapa sebab teknikal yang lain. Sebelum itu Penasihat DAP, Lim Kit Siang, melahirkan rasa ragu beliau meskipun ahli parlimen veteran itu berpendapat, tindakan SAPP semalam mempunyai implikasi politik yang penting.

Aziz, pensyarah UIAM menjelaskan kedudukan kerajaan di bawah sistem demokrasi berparlimen ditentukan oleh sokongan majoriti dan apabila timbul persoalan mengenainya maka dewan perlu diberi peluang untuk mempastikan soal itu. Soal-soal teknikal perlu dikesampingkan kerana ini adalah soal yang melibatkan sama ada kerajaan yang ada boleh kekal atau meletakkan jawatan. Aziz memberi beberapa hujah untuk menyokong pendapatnya itu. Yang pertama hujahnya, ialah soal sokongan majoriti itu penting sebagaimana yang disebut oleh Perlembagaan dalam beberapa peruntukan bermula dengan Perkara 43(2)(a). Ini diikuti oleh Perkara 43(4) yang mewajibkan Perdana Menteri meletakkan jawatan sekiranya beliau kehilangan sokongan majoriti.

Yang kedua ialah bahawa kuasa Speaker adalah berdasarkan peraturan tetap dewan (standing orders) yang dibuat berdasarkan Perkara 62(1). Dengan kata lain adalah tidak munasabah jika undang-undang kecil mengatasi Perlembagaan. Beliau berhujah ini tidak selaras dengan Perkara 4(1) yang meletakkan Perlembagaan sebagai undang-undang tertinggi negara.

Yang ketiga kuasa mutlak Speaker adalah berhubung dengan perjalanan mesyuarat dewan tidak harus disalahgunakan untuk menyelamatkan kerajaan yang kehilangan kekuatan untuk memerintah. Aziz menegaskan jika Speaker dibenarkan menyekat usul tidak percaya maka sistem demokrasi berparlimen - di mana kerajaan dilantik berdasarkan sokongan majoriti di dalam dewan akan hancur. Ini juga membawa makna konsep kerajaan bertanggungjawab (responsible government) yang sentral di dalam demokrasi Westminster tidak terlaksana.

Yang keempat, hujah Aziz lagi, dakwaan mengenai kuasa Speaker itu bertentangan dengan amalan yang konsisten setakat ini. Pensyarah UIAM itu berkata setakat ini sudah tiga kali kerajaan tumbang di tangan undi tidak percaya di Malaysia. Beliau menegaskan kedua-dua Persekutuan dan Negeri mempunyai undang-undang yang sama. Perletakan jawatan kerana gagal dalam usul tidak percaya berlaku buat pertama kalinya di Sarawak pada tahun 1966 melibatkan Ketua Menteri, Datuk Stephen Kalong Ningkan. Kemudian ia diikuti oleh perletakan jawatan oleh Menteri Besar, Dato Harun Idris di Selangor pada tahun 1976 yang diundi tidak percaya oleh partinya sendiri. Insiden yang sama berlaku di Kelantan pada tahun 1977 apabila Menteri Besar Dato Mohamed Nasir berbalah dengan partinya sendiri. Aziz mengharapkan semua pihak, termasuk Speaker, perlu memberi laluan kepada proses yang telah pun secara konsisten diamalkan di seluruh dunia Komanwel. SAPP's VoTe OF No CoNFiDeNCe AGaiNsT PM...'IT's TiMe To Go DoLaH BaDaWi'...

KOTA KINABALU: The Sabah Progressive Party (SAPP) has lost confidence in Prime Minister Datuk Seri Abdullah Ahmad Badawi, it said at a press conference here Wednesday. In the coming sitting of the Parliament session on Monday, its two Members of Parliament will support a vote of no confidence against the Prime Minister, the party said. Whether its MPs table the vote of no confidence, or whether other MPs will do it, would be determined in due course, it said in a statement.

SAPP’s two MPs are Datuk Eric Enchin Majimbun (P171 Sepanggar) and Datuk Dr. Chua Soon Bui (P190 Tawau). The party also has four state representatives. The statement was read out by Dr. Chu and signed by Majimbun, who was overseas on official duties. He will be back for the Parliament sitting next Monday, June 23. The statement listed four areas of dissatisfaction with Abdullah's premiership:

(1) That no concrete action had been taken on the issue of illegal immigrants, despite repeated requests by SAPP and other Barisan component parties;
(2) That the government had offered no holistic economic solutions to cushion the blow of the sudden hike in fuel prices, which had greatly burdened the people and threatened further hardcore poverty;
(3) That not enough attention had been paid to issues raised by the people of Sabah-poor delivery systems, corruption, wastage, lack of transparency and accountability and that SAPP would have failed in its duty as elected representatives if these issues continued to be ignored; and
(4) That the people have lost confidence in Abdullah, and that if he can't perform, he should step aside and make way for another leader to take over.


Talk had been rife Wednesday morning that SAPP was going to abandon the Barisan Nasional coalition and defect to the Pakatan Rakyat alliance. The party is running a poll on its blog, asking members of the public whether it should stay on in Barisan, leave the coalition but remain independent, or join Pakatan. At press time, there were 874 votes tallied, with 83% (728 votes) asking SAPP to join Pakatan. Only 2% (25 votes) urged it to stay on with Barisan. - The STaR ONLiNe
